                             1.  About this Privacy Policy

1.1       This Privacy Policy explains how Lisa Hunter Smith, sole trader (ABN 19 010 903 039), trading as Medical Mindfulness (Medical Mindfulness, we, us, our), collects, holds, uses, and discloses personal information about students who enrol in our online continuing professional development courses (Courses), currently Medical Mindfulness 101 and Medical Mindfulness 202.

1.2       This Privacy Policy should be read together with our Terms and Conditions, available at https://www.armchairmedical.tv/mm-terms-2026.

1.3       The Courses are delivered through the armchairmedical.tv website, which is operated by ArmchairMedical Pty Ltd. Course videos are delivered via the Vimeo streaming service. Both ArmchairMedical and Vimeo handle certain personal information about students independently of Medical Mindfulness, in accordance with their own privacy practices. This Privacy Policy describes what Medical Mindfulness does with your personal information; it does not describe what ArmchairMedical or Vimeo do with information they collect independently.

 

                             2.  Application of the Privacy Act and Australian Privacy Principles

2.1       The Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs") set out how personal information must be handled in Australia. Some small businesses are exempt from the Privacy Act.

2.2       Regardless of whether the Privacy Act strictly applies to Medical Mindfulness, we adhere to the APPs as a matter of best practice. This reflects the fact that our students are registered health practitioners with heightened privacy expectations, and the sensitivity of some of the information handled in the course of delivering the Courses.

 

                             3.  What personal information we collect

3.1       The kinds of personal information we collect about you may include:

(a)  your name and professional title;

(b)  your email address and, if you provide it, your phone number;

(c)  if you provide it, your AHPRA registration number or college membership number (RACGP, ACRRM, etc.);

(d)  if required for invoicing, your postal address or practice address;

(e)  the Course(s) you enrol in and the date of enrolment;

(f)   your progress through the Course, including which modules you have accessed and completed;

(g)  your submissions to Course assessments, including any written reflections;

(h)  your contributions to any peer-learning discussions within the Course;

(i)   records of communications between you and Medical Mindfulness (for example, support emails);

(j)   technical information collected by the Course platform, such as your IP address, browser type, and pages visited within the Course.

3.2       We do not collect or store credit card or other payment card details. Payment is processed by ArmchairMedical (as merchant of record) through the Kajabi platform, and payment card details are handled by that platform and its underlying payment processor.

 

                             4.  Sensitive information

4.1       Some of the personal information we collect is "sensitive information" as defined by the Privacy Act. This may include:

(a)  your professional membership information (for example, AHPRA registration or college membership), if you provide it; and

(b)  health information contained in your assessment submissions or peer-learning contributions (for example, if you write a reflection on a clinical case).

4.2       By enrolling in a Course and providing sensitive information to us, you consent to our collection, use, and disclosure of that information for the purposes set out in clause 5 of this Privacy Policy.

4.3       Patient information in peer-learning discussions. If you discuss a clinical case as part of a Course assessment or peer-learning activity, you must de-identify any patient information before sharing it. Do not include patient names, dates of birth, addresses, contact details, Medicare numbers, or any other identifying information. Discussing a case in a way that identifies a patient without their consent may be a breach of your professional obligations and of Australian privacy law.

 

                             5.  Why we collect personal information

5.1       We collect, hold, use, and disclose personal information for the following purposes:

(a)  to deliver the Course to you, including making the modules and materials available and enabling you to complete assessments;

(b)  to communicate with you about the Course, including reminders, updates, and support;

(c)  to enable ArmchairMedical (as merchant of record) to process your payment and issue you a tax invoice;

(d)  to issue you a Statement of Completion, CPD certificate, or other documentation you may need to claim CPD hours or the GPMHSC training subsidy;

(e)  to report the fact of your completion of a Course to the relevant accrediting colleges (see clause 6);

(f)   to send you occasional marketing communications about our other Courses (see clause 7);

(g)  to improve our Courses, including by reviewing assessment and feedback data;

(h)  to comply with our legal, tax, and audit obligations; and

(i)   to respond to enquiries and complaints.

 

                             6.  Who we share personal information with

6.1       We share personal information about you only with the parties listed in this clause 6. We do not sell or trade your personal information for any purpose.

6.2       ArmchairMedical Pty Ltd.  As merchant of record for Course sales, ArmchairMedical receives your name, email address, and payment transaction details. ArmchairMedical holds this information in accordance with its own privacy practices.

6.3       Kajabi.  The Courses are hosted on the Kajabi online course platform. Kajabi stores your account details, Course progress, assessment submissions, and peer-learning contributions. Kajabi is operated by Kajabi, LLC and its servers are located in the United States of America.

6.4       Vimeo.  Course videos are streamed via Vimeo. Vimeo collects viewing analytics (such as which videos you have viewed and for how long) and technical information such as your IP address. Vimeo is operated by Vimeo.com, Inc. and its servers are located in the United States of America.

6.5       Accrediting colleges.  On your completion of a Course, we report the following information to the accrediting body of the Course (as applicable: RACGP, ACRRM, MyCPD Home, or GPMHSC), so that you may receive CPD credit:

(a)  your name;

(b)  the Course name;

(c)  the date of completion; and

(d)  the CPD hours claimable.

We do not share your assessment content, reflective writing, or peer-learning contributions with the accrediting colleges.

6.6       Professional advisors.  We may share personal information with our accountant, lawyer, or other professional advisors on a confidential basis where reasonably necessary.

6.7       Legal or regulatory requests.  We may disclose personal information where we are required or authorised to do so by law, or in response to a valid request from a regulatory or law enforcement authority.

 

                             7.  Marketing communications

7.1       From time to time we may send you marketing communications about our other Courses. These communications are infrequent.

7.2       Every marketing email includes a link to unsubscribe. If you unsubscribe, we will stop sending you marketing communications, but we may continue to contact you about the Course(s) you are currently enrolled in.

7.3       We do not share your contact details with any third party for that third party’s marketing purposes.

 

                             8.  Overseas disclosure of personal information

8.1       Some of your personal information is held on servers located outside Australia, in the United States of America. Specifically:

(a)  the Kajabi course platform (see clause 6.3) hosts your account, progress, and Course-related data on servers in the United States; and

(b)  the Vimeo streaming service (see clause 6.4) hosts video content and viewing analytics on servers in the United States.

8.2       When personal information about you is disclosed to an overseas recipient, Australian Privacy Principle 8 requires us to take reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to that information. We do this by using established, reputable platforms whose published privacy commitments are consistent with the APPs.

 

                             9.  Cookies

9.1       The armchairmedical.tv website uses cookies to make the Course platform work. A cookie is a small text file that is placed on your device when you visit a website.

9.2       The cookies used on the Course platform are essential functional cookies. They are used to:

(a)  keep you logged in to your account during a session;

(b)  remember your progress through the Course; and

(c)  ensure the Course platform functions correctly.

9.3       We do not use advertising, marketing, or tracking cookies. We do not use third-party analytics tools (such as Google Analytics or Facebook Pixel) on the Course platform.

9.4       You can control cookies through your browser settings. Disabling essential cookies may prevent the Course platform from functioning correctly.

                             10.  How we hold and protect personal information

10.1     Personal information about you is held primarily on the Kajabi online course platform. Kajabi maintains commercial-grade security controls for the platform, including encryption of data in transit.

10.2     Access to your personal information within Medical Mindfulness is limited to Lisa Hunter Smith and, where necessary for support or delivery, to authorised personnel of ArmchairMedical.

10.3     Despite our care, no online service can guarantee absolute security. If you become aware of any unauthorised access to your account or personal information, please contact us immediately at [email protected].

 

                             11.  How long we keep personal information

11.1     We retain your personal information for seven (7) years after your last enrolment in a Course, so that we can:

(a)  reissue Statements of Completion or CPD documentation to you if you request it during that period;

(b)  respond to audits or enquiries from accrediting colleges regarding your completion of a Course; and

(c)  meet our tax and business record-keeping obligations.

11.2     After the seven-year period, we will securely delete or de-identify your personal information, except where we are legally required to retain it for a longer period (for example, under taxation law).

11.3     You may request that we delete your personal information at any time by emailing us at [email protected]. On receipt of such a request, we will delete or de-identify your personal information, except where we are legally required to keep it or where deletion would prevent us from providing you with a Course you remain enrolled in.

 

                             12.  Your rights: access and correction

12.1     Access. You have the right to request access to the personal information we hold about you. We will provide access within a reasonable period (usually 30 days) and generally at no cost, subject to any exceptions permitted under the Privacy Act.

12.2     Correction. You have the right to request that we correct any personal information we hold about you that is inaccurate, out of date, incomplete, irrelevant, or misleading. If we agree the correction is needed, we will make it at no cost. If we do not agree, we will provide you with a written explanation and (if you request) will attach a statement of your view to the record.

                             13.  Complaints about privacy

13.1     If you have a complaint about how we have handled your personal information, please contact us at [email protected] in the first instance. We will acknowledge your complaint within 5 business days and aim to respond substantively within 30 days.

13.2     If you are not satisfied with our response, you may make a complaint to the Office of the Australian Information Commissioner:

                             14.  Children

14.1     The Courses are intended for adult health professionals. We do not knowingly collect personal information from anyone under the age of 18. If you become aware that a person under the age of 18 has provided personal information to us, please contact us and we will delete it.

                             15.  Third-party websites

15.1     The Course materials, Course platform, and our communications may contain links to third-party websites (for example, the GPMHSC website). We are not responsible for the privacy practices of any third-party website. When you follow such a link, please read the privacy policy of the third-party website before providing any personal information.

                             16.  Changes to this Privacy Policy

16.1     We may amend this Privacy Policy from time to time. The current version is always available at https://www.armchairmedical.tv/mm-privacy-policy-2026.

16.2     If we make a significant change, we will notify enrolled students by email.

[LEGAL REVIEW]  The URL in clause 16.1 includes "2026". Consider whether this should be a permanent year-stamped URL (with new URLs for future annual versions), or whether the "2026" should be removed so the URL remains stable across versions. If year-stamped, ensure the URL in the Terms and Conditions and on the checkout page always points at the current year’s version.
